Common legal boundaries of compensation

The pair will discuss the principles governing compensation for expropriation, highlighting debated aspects and how those debated issues translate into different valuation and compensation criteria.

The presentation will provide a snapshot of:

  • the current status of customary international law;
  • the language contained in BITs; and
  • how they have been construed and applied by arbitral tribunals.

Sanz has extensive experience of both international commercial and investment treaty arbitrations involving disputes in a broad range of sectors, including infrastructure and highway concession agreements, oil and gas, energy, water treatment, technology, public works, sovereign debt, and agribusiness.
