Leilah Bruton quoted in CDR Magazine article on revision of ICSID rules

Leilah Bruton has been quoted in the article, “ICSID publishes new rules”, by Robert Li, published in Commercial Dispute Resolution (CDR) Magazine. The article explored three key issues addressed in the first revision of the ICSID rules in sixteen years: streamlining, third-party funding, and transparency.

Leilah spoke about the “very lengthy” nature of ICSID proceedings and that “associated inefficiencies and costs have been a source of criticism for years”, noting that “parties can opt into expedited arbitration which can fast track a case – with shorter timelines for written submissions and limitations on length, all these measures taken together are intended to make the process faster and more efficient”.

On the topic of funding, she discussed the amendments to the rules that require parties to disclose funding arrangements, to address concerns that Member States had; that funders “were hiding their identities behind corporate structures, with the potential for undisclosed conflicts”.

Leilah turned to the issue of transparency, addressing ICSID’s response to calls for greater accountability through revisions to its rules which provide for greater transparency in the conduct and outcome of proceedings.
