Kimberly Larkin, Julia Sherman, Kelly Renehan and Anish Patel have authored the “Using Technology and e-Disclosure” chapter in the first edition of Global Arbitration Review’s The Guide to Evidence in International Arbitration.
E-disclosure – or the production of electronically stored information (ESI) is increasingly prevalent in international arbitration. More and more information is being transmitted and stored in electronic and technological form and this has led arbitration practitioners to seek, and tribunals to order, substantial amounts of e-disclosure. This presents both opportunities and challenges for international arbitration practitioners.
The chapter looks at the current state of play on production of ESI, e-disclosure practices in the United Kingdom and the United States, technological solutions and strategies, and determining the need for an ESI database.

ABOUT KIMBERLY LARKIN
Kimberly, an associate in the Washington, DC office of Three Crowns, represents clients in international commercial and investment arbitrations across a variety of sectors, including the technology, energy, mining and natural resources, and financial services industries.

Julia, an associate in the firm’s Washington, DC office, has significant experience in public international law, including acting for States before the International Court of Justice and other international arbitral tribunals. She has also represented clients in commercial and investment arbitrations in a range of sectors, including energy, technology, and financial services.
Julia holds a JD from Columbia Law School in New York where she was a James Kent and Harlan Fiske Stone Scholar and received the David M. Berger Memorial Prize in International Law. At Columbia, Julia served as the Editor-in-Chief of the Columbia Human Rights Law Review.
ABOUT KELLY RENEHAN
Kelly is a senior paralegal in the Washington, DC office. She has supported numerous international arbitration cases under almost all major arbitration rules, many of them from the inception of the case to the final hearing. She has been the lead paralegal in hearings in London, Paris, New York and Washington, DC.
Kelly has managed several cases involving complex and large-scale e-discovery during her time at Three Crowns, including assisting with organising collections, creating protocols for in-house and third-party reviewers, and producing documents in various formats using several different e-discovery platforms.
ABOUT ANISH PATEL
Anish is a Three Crowns practice manager, based in London. In addition to being responsible for a number of business services functions, he has assisted teams on multiple cases under all major arbitration rules. He has supported teams at final hearings, including in London, Paris, Singapore, Stockholm, Toronto, and Washington, DC.
Anish is a steering committee member for the Campaign for Greener Arbitrations and is chair of the Community Building, Networking and Scholarship Committee of the Racial Equality for Arbitration Lawyers organisation.
