In the past decade, the world has seen powerful autocratic regimes succumb to takeovers and give way to transitional governments. The Arab Spring of 2011 alone resulted in the collapse of the regimes in Libya, Tunisia, Egypt, and Yemen.
The political changes that have taken place in these regions have posed important questions of public international law relevant to investors, banks who often stand behind large-scale investments in the jurisdictions with high sovereign risk, and political risk insurers, as well as diplomats and other government representatives.
Events like these raise serious legal issues, including:
- Who does an investor sue in a situation where there are competing political fractions or a sudden overthrow of an established regime?
- Who is responsible for the acts of a political faction or a government that is not recognised universally?
- What steps to take to ensure that the obligations of the deposed government are honoured by the transitional government?
ABOUT REZA MOHTASHAMI QC
Mohtashami has represented clients as counsel and advocate in more than 80 arbitrations conducted under a variety of arbitration rules in many different jurisdictions. He has particular expertise in disputes arising in emerging markets, including in countries suffering the effects of civil conflict where the central government’s authority is under challenge.
Mohtashami is a qualified English solicitor-advocate and was appointed Queen’s Counsel in recognition of his advocacy skills in 2018. He is as an officer of the IBA Arbitration Committee, trustee of the DIFC-LCIA Arbitration Centre, member of the board of trustees of the Bahrain Chamber for Dispute Resolution, and an editorial board member of the ICC Dispute Resolution Bulletin and Global Arbitration Review.
