Ridhi Kabra has authored the “International Investment Law in Indian Courts” chapter in International Investment Law – An Analysis of the Major Decisions, published by Bloomsbury.
As part of the book’s endeavour to assess the contributions of national judges to the development of investment law, Ridhi’s chapter examines India’s contribution through an analysis of decisions relating to India’s attempt to seek injunctions against investment treaty arbitrations. Through a review of three domestic cases, the chapter considers (i) the source and extent of a domestic court ’s power to injunct investment treaty proceedings; (ii) the practical impact of such injunctions on investment treaty proceedings; and (iii) the potential for such injunctions to engage the international responsibility of States.
