Nicola Peart will be moderating a panel on “Human Rights and Investment Arbitration” at the Penn Law International Arbitration Association, International Arbitration Conference 2022.
The session will consider how human rights issues arise in investor-State arbitration. Issues considered by the panel will include: the development of business and human rights principles and standards and their hardening through regional developments, national legislation and domestic litigation, the relevance of these principles and standards for investors seeking to access protections under investment treaties, the extent to which human rights are relevant to investment protection under international law, as well as access to compensation, and whether international arbitration is an appropriate forum for addressing human rights issues.

Nicola, a senior associate in the Washington, DC office, practises in all aspects of international dispute resolution. Her experience includes international commercial and investment treaty arbitration, as well arbitration under the UN Convention on the Law of the Sea and proceedings before the International Court of Justice. She also advises and represents parties in arbitration-related court matters, including before the UK Supreme Court.
