Ilija Mitrev Penushliski will speak at the third edition of the VIAC CAN Congress. The congress, hosted by the Vienna International Arbitration Centre (VIAC), will focus on the theme “Shaping the future of arbitration in CEE / SEE for the next 50 years”.
Ilija will moderate a panel titled, “Help, police! I mean … arbitrator! Arbitrating in the Shadow of Crime”, featuring speakers Luminita Popa (Popa Legal), Eva Kalnina (Arbitration Chambers), Kamalia Mehtiyeva (Professor of Law, Université Paris-Est Créteil), and Sylvia Tonova (Pinsent Masons).
The panel will discuss the growing incidence of criminal-law related issues arising in arbitration, such as the admissibility of illegally obtained evidence, the interaction of INTEROL and mutual legal assistance proceedings and arbitral proceedings, the duty on arbitrators to deal with illegality, and the effect of domestic criminal court decisions on matters before tribunals.
