Farouk El-Hosseny, a senior associate in the London office of Three Crowns, recently co-authored “Contributory Fault under International Law: A Gateway for Human Rights in ISDS?” for the International Centre for Settlement of Investment Disputes’ ICSID Review – Foreign Investment Law Journal.
In the piece, the authors consider the concept of contributory fault under international law, including how it has been applied by international courts and tribunals. They also shed light on its application in the burgeoning area of investment treaty arbitrations raising issues of human rights.
