Aarushi Nargas moderated a panel titled “Modeling Investment Arbitration: Treaty Negotiation” at the HIALSA x Three Crowns Masterclass Series at Harvard Law School on Tuesday, April 7.

The discussion explored how investment treaty negotiation is increasingly shaped by the need to anticipate future disputes—moving beyond drafting legal standards to modeling how tribunals, investors, and states behave in practice. The panel also examined whether more precise treaty drafting has meaningfully improved predictability in arbitration, the limits of designing around risk, and how emerging challenges such as regulatory change and geopolitical pressures are influencing treaty design.

The panel featured Hansel Pham (White & Case) and Lauren Mandell (WilmerHale). The panel took place at Harvard Law School as part of the HIALSA Masterclass Series 2025–2026.
